Terms of the Customer Satisfaction Survey Draw

The Entrant (the "Entrant" or "You") hereby agrees with 1429481 Ontario Inc. o/a Pathway Communications, 95 Apple Creek Blvd., Markham, ON L3R 1C7, and its officers, directors and employees (collectively referred to as "Pathway Communications" or "Pathway") that in consideration of Pathway conducting the survey and the prize draw, the Entrant agrees to all of the following terms and conditions which are subject to the terms of the Customer Satisfaction Survey prize draw.
Survey Draw
To be eligible for the draw, you will need to complete the survey, in full, by midnight on September 16, 2011. A draw will be made, from all eligible entries received. Following the draw, the selected entrant will be contacted by email and/or telephone at the email address and telephone number in our account information.
1. In order to be declared a winner, the selected entrant must:
a. Respond to the prize notification within five (5) days of transmission by Pathway communications; and
b. Sign a declaration stating that he/she:
i. Releases and discharges Pathway Communications;
ii. Consents to the announcement of the winner's name and the use by or on behalf of Pathway Communications of the winner's name, address, voice or statements for advertising and promotional purposes without any further compensation to the winner.
2. Should the selected entrant fail to comply with any of the requirements set out in paragraph 11, the prize will be automatically forfeited and another entrant will be selected by random draw.
3. The chances of winning depend upon the number of eligible entries received.
Disclaimer and Liability Exclusion
4. Pathway Communications will not, under any circumstances, be responsible for, or liable to any Survey entrant or any other person for:
any erroneous, lost, damaged, late, incomplete, misdirected, deleted, defective, or altered Survey entries, regardless of the cause;
any failure for any reason whatsoever of the selected entrant to receive a prize notification email;
any computer, online, telephone, or technical malfunctions or errors that may occur, regardless of the cause; or
any damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Survey or the submission of entries to the Survey or participation in the Survey or the Survey prize, or the use of the Pathway Communications web site (including the downloading of any materials from that web site) and regardless of the cause or any negligence by Pathway Communications or anyone for whom Pathway Communications are responsible, and notwithstanding that Pathway Communications may have been advised of the possibility of such loss or damage being incurred.
Other Matters
5. If for any reason the Survey is not capable of being conducted as intended by Pathway Communications, including due to computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts or interferes with the administration, security, fairness, integrity or proper conduct of the Survey, Pathway Communications may, at its sole discretion, disqualify any entrant responsible for such misconduct and cancel, terminate, modify, or suspend the Survey.
6. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE SURVEY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND PATHWAY COMMUNICATIONS RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
7. Return of any prize notification email as undeliverable or non-availability on phone may result in disqualification, and an alternate winner may be selected.
8. Decisions of Survey prize draw Judges are final and binding on all entrants.
9. Participation in the Survey constitutes acceptance and agreement to these Survey Rules.
10. Pathway Communications reserves the right, at its option, to publish the winner's name, address, photograph, likeness, voice or statements without any further compensation to the winner.
11. The Survey is subject to all applicable federal, provincial and local laws.
